The U.S. Eagle loans

The lawsuit against U.S. Eagle

Fidelity Bank of Texas, a bank in Waco, sued U.S. Eagle Federal Credit Union in U.S. District Court in Albuquerque on September 15, 2026 (case 1:26-cv-03071). The complaint alleges breach of contract, breach of the duty of good faith and fair dealing, and fraud over a $5 million piece of a U.S. Eagle loan that the bank bought in early 2024.

A complaint is one side's claim, not a court's finding. Every allegation in it is the bank's. U.S. Eagle's answer was due October 8. As of October 11, 2026, the court's docket showed no answer, no appearance and no request for more time. The docket is public on CourtListener, and any filing after that date will appear there.

The Ledger bought the complaint from the court's PACER system and publishes it here word for word, as the court holds it. Nothing is edited or redacted.

Read part one of the series: U.S. Eagle lent most of its business money out of state. $165 million of it isn't being paid back. Part two, which checks the bank's claims against the public record, is coming.

The Ledger asked U.S. Eagle written questions about the loans and published its statement in full. Our standards are here.
